Terms and conditions

This Participant Release, Waiver and Indemnity Agreement (this “Agreement”) is between the participant named above and the Multiple Sclerosis Society of Canada and its affiliates (collectively, “MS”).


I, the participant named above, understand and agree that my participation in the Event is conditional upon my agreement to the terms and conditions of this Agreement.


    1. I agree to follow all applicable MS rules and guidelines for participation in the Event. I acknowledge and agree that I am solely responsible for my safety, and for the safety of all minors under my care who are participating in the Event. I agree that I will not leave any minor under my care unattended at any time.
    2. I am aware that the Event may involve risks and dangers of injury, whether serious or not, and possibly death. These risks and dangers may be caused by my own actions or inactions, the actions or inactions of other participants in the Event, the condition in which the Event takes place, or the negligence of the Releasees named below. I accept these risks and dangers, as well as all others arising from the Event, whether known or unknown. I assume sole responsibility for all losses, costs and/or damages which I incur as a result of my participation in the Event, even if caused by the negligence or the Releasees named below.
    3. I confirm that my health is satisfactory to meet the requirements of the Event (including any ancillary activities associated with the Event), and that any equipment I provide and use in participating in the Event will be mechanically sound and will meet all safety standards. I agree to immediately discontinue participation in the Event if I observe any unusual hazard or unsafe conditions, or I feel unable or unfit to safely continue for any reason.
    4. By agreeing to this waiver , I RELEASE, DISCHARGE AND AGREE NOT TO SUE MS, any relevant municipality or other governmental authority, any owner or lessor of premises on which the Event or any ancillary activities take place, as well as all other participants, sponsors, advertisers and suppliers, and their respective administrators, directors, agents, owners, officers, volunteers or employees (each, a “Releasee”) from all liabilities, claims, demands, losses, damages, injuries or expenses that I may suffer as a result of my participation in any part or parts of the Event, whether as a participant, spectator, competitor or otherwise, which is caused or alleged to be caused in any way, in whole or in part, by the Releasees, including any negligence of the Releasees or otherwise.
    5. I also agree that if, despite this Participant Release, Waiver and Indemnity Agreement, I, or anyone on my behalf, makes any claim against any of the Releasees, I will indemnify, save and hold harmless each of the Releasees from any litigation expenses, legal costs, losses, liabilities, damages or costs which any of the Releasees may incur as a result of such claim.
    6. In addition, by participating in the Event, I consent to the use of my name, likeness and/or voice, or that of any minor under my care, in any future publicity, fundraising or other material or activities carried out by MS. I acknowledge that I will not receive any financial compensation for any of the above uses.
    7. I confirm that I am of lawful age and legally competent to agree to this Participant Release, Waiver and Indemnity Agreement.


I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP IMPORTANT LEGAL RIGHTS, INCLUDING MY RIGHT TO SUE AND ANY RIGHTS MY HEIRS, EXECUTORS, OR BENEFICIARIES MAY HAVE TO SUE THE RELEASED PARTIES RESULTING FROM MY DEATH. I HAVE BEEN INFORMED OF MY RIGHT TO OBTAIN INDEPENDENT LEGAL ADVICE AND AGREE THAT I HAVE EITHER OBTAINED THAT LEGAL ADVICE OR HAVE WAIVED THE RIGHT TO OBTAIN SUCH LEGAL ADVICE. I HAVE agreed FREELY AND WITHOUT INFLUENCE, INDUCEMENT OR ASSURANCE OF ANY NATURE. I INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW, AND AGREE THAT IF ANY PORTION OF THE AGREEMENT IS HELD TO BE INVALID, THE BALANCE SHALL CONTINUE TO FULL FORCE AND EFFECT.



If applicable, a parent and/or legal guardian is required to accept this waiver on behalf of a person under the age of majority.
